We are not asking you to join as a representative (named) plaintiff in our existing class action lawsuits, we are instead looking to have you join our confidential employee database that is meant to assist us in strengthening the overall case and optimizing the recovery that you are entitled to. Naturally, there are circumstances when we might identify information specific to yourself that might identify a distinct legal avenue to pursue additional compensation for yourself and others, which may not be covered in the current form of class proceedings. In those circumstances, we will need to address this specifically with yourself and ascertain whether or not you wish to be pursuing this additional legal recourse.

Also, the hotel's lawyers will all too often look to reduce the size of the class, such that they might be seeking to effectively exclude yourself from the class. Yet, absent our identifying a new and distinct legal claim against the defendants, the purpose of joining is to enable us to make sure you are fairly compensated from this class proceeding, such that we need to hear from you. If we don’t hear from you, we will be forced to rely upon information obtained from the hotel and certain third-party providers that may be incomplete or might overlook critical information that is specific to yourself.

The more former and current employees of the hotel who register, the stronger our court case can become.


Joining costs you nothing. It’s free. You will not pay any legal fees as a class member. It’s confidential. Your name and information that you  will remain completely confidential. Naturally, if you seek individualized legal representation and/or have distinct claims against the hotel, there are additional considerations that must be accounted for and we must agree to the specific terms of that engagement and our legal representation on those particular matters.

For class members, other than the representative plaintiff(s) and certain other individual class members who raise additional individual claims against the hotel within the forum of the court case, the class proceeding is meant to keep the class members' involvement confidential from the hotel. As such, the hotel is not allowed to be informed as to who is a participant in the class and who has opted out and how much any individual class member is paid out. The hotel's lawyers will know this information; however, they are legally obligated not to reveal this to their client (the hotel), as they can be punished by the Court for disclosing such information. So, by way of an example, the vice-president of a hotel may choose not to opt-out and the class proceedings might determine that she is entitled to $20,000 in underpayments. The fact that she chose not to opt-out of the class proceedings and the amount of money that she received would not be revealed to the hotel, even as she continues to work for the hotel.
